Athalia I. Magaña

Overview

Athalia Magaña is an associate in the firm’s San Diego office. She represents employers against claims for wrongful termination, retaliation, harassment, discrimination, wage and hour claims, and the Private Attorneys General Act (“PAGA”). Ms. Magaña defends employers in both state and federal courts, administrative hearings, and arbitrations. She also advises employers and human resource professionals on a broad range of labor and employment matters including day-to-day employment issues, wage and hour laws, leave laws, employee classification, discipline and termination, and employee handbooks. She has experience advising and representing clients across various industries including healthcare, finance, technology, hospitality, retail, and more. Ms. Magaña has experience in all aspects of litigation from the inception of a claim, through trial.

Prior to joining the firm, Ms. Magaña worked at a national defense firm in their Labor and Employment group. She earned her undergraduate degree from the University of California, Irvine. She earned her law degree from California Western School of Law in San Diego, CA. In law school, Ms. Magaña was honored for repeated inclusion on the Dean’s List and she received the American Jurisprudence Award for achieving the highest grade available in Trial Practice. She was also awarded the Distinguished Advocate Award as a top competitor in a trial competition.

Ms. Magaña is a member of the San Diego La Raza Lawyers Association and fluent in Spanish.

Outside of her law practice, she enjoys running, training for triathlons, and spending time with her family.
