- April 2026: Prevailed on a motion to quash a subpoena issued to a third-party video surveillance company in a premises liability matter venued in Los Angeles Superior Court. The court found the plaintiff’s discovery was excessive and violated the court’s prior protective order on the same topic. The court also granted our client’s motion to bifurcate liability and damages issues at the upcoming trial.
- April, 2026: Prevailed on a motion for summary judgment for our client, a government entity, in a premises liability/personal injury matter venued in Los Angeles Superior Court. The court held the alleged road hazard was an open and obvious condition, and the plaintiff failed to demonstrate the defect was anything more than minor, trivial, or insignificant, and therefore not a dangerous condition as a matter of law
- March, 2026: Prevailed on a motion for summary adjudication, dismissing a plaintiff tenant’s personal injury claim against our client, an apartment community, when the plaintiff injured herself moving her own furniture to prepare for remediation of a leak by the apartment community’s vendor. The apartment community offered the plaintiff a vendor to move the plaintiff’s belongings, but the plaintiff refused. The Court agreed the apartment community did not owe a duty to the plaintiff in this circumstance.
- March, 2026: Prevailed on a motion for summary judgment for our clients, a retail store operator and its store manager, in a premises liability/ personal injury matter venued in Los Angeles Superior Court. The court found that plaintiff could not establish causation or any breach of duty by our clients.
- March, 2026: Prevailed on a motion to strike punitive damages in plaintiff’s second amended complaint for our residential apartment community client in a premises liability matter venued in Orange County Superior Court. The court found plaintiff was not entitled to claim punitive damages under the case facts after two prior attempts to properly plead punitive damages.
- February, 2026: Prevailed on a motion for summary adjudication for our real estate investment trust and residential apartment community clients in a habitability/negligence matter venued in Los Angeles Superior Court. The court found Plaintiffs were not entitled to punitive damages and Plaintiffs could not provide evidence to prove their claims for fraud, negligent misrepresentation, and intentional infliction of emotional distress.
- February, 2026: Prevailed on a motion for summary judgment for our client, a real estate broker, in a premises liability/personal injury matter venued in Los Angeles Superior Court. The court found no notice, no dangerous condition, and no breach of the duty of care.
- February, 2026: Prevailed on a motion for summary judgment in a high‑exposure, catastrophic injury case venued in Los Angeles Superior Court. The court found none of the Privette exceptions applied, preventing plaintiffs from recovering from our client, a commercial amusement operator, on premises liability, negligence, and loss of consortium claims.
- February, 2026: Prevailed on a motion for summary judgment in Los Angeles Superior Court against both the Plaintiff’s complaint and the Co-Defendant’s cross-complaint. The court found our client, a national retailer, did not create a “danger zone” and was not liable for injuries resulting from a pedestrian-vehicle accident in the parking lot.
- October, 2025: Secured a unanimous defense verdict for our HOA client after a month-long trial in Beverly Hills, where the Plaintiffs sought $15 million in claimed damages. The jury rejected all negligence, premises liability, and nuisance theories arising from a dog-bite incident, positioning our client to recover significant fees and costs under CC&R fee-shifting provisions.
- April, 2025: Obtained a complete defense verdict in Kern County Superior Court for our client, an agricultural service provider, after an eight-day trial. The jury found no negligence related to claims arising from a low-speed tractor versus sedan accident on private property.
- March, 2025: Prevailed on a motion for summary judgment in a personal injury case venued in San Diego County Superior Court. The court found a statute applicable to builders and installers of public playgrounds did not apply to our client, a salesperson for playground equipment.
- February, 2025: Prevailed on a motion for summary judgment in San Bernadino County Superior Court in a high-exposure wrongful death case arising from a stabbing in the parking lot of our client, a bar owner/operator. The court found our client owed no duty to the decedent.
- November, 2024: Prevailed on a motion for summary judgment in San Diego County Superior Court for our food & beverage industry client in high-exposure premises liability case involving a traumatic brain injury. The court found our client owed no duty of care to the plaintiff, who claimed to have been assaulted by another patron.
- July, 2024: Achieved a full defense verdict after a lengthy trial in Orange County Superior Court involving a multi-million-dollar personal injury claim. After deliberating for approximately 30 minutes, the jury rejected all claims against our client, a national retailer.
- Prevailed on a Motion for Judgment on the Pleadings and obtained dismissal for a retail client in a premises liability case venued in Los Angeles Superior Court.
- Successfully briefed, argued, and prevailed on a Motion for Judgment on the Pleadings resulting in the dismissal of a premises liability case venued in Los Angeles County.
- Successfully briefed, argued, and prevailed on a Motion for Summary Judgment in a premises liability case venued in Los Angeles County.
- Successfully briefed, argued, and prevailed on a Motion for Summary Judgment for our client in a premises liability case venued in Los Angeles County.
- Successfully briefed, argued, and prevailed on a motion for summary judgment for restaurant client in premises liability case venued in Los Angeles County by undermining causation element in slip and fall case.
- Prevailed on motion for summary judgment in trip and fall premises liability case venued in Los Angeles County based on absence of duty by property owner client to repair adjacent sidewalk.
- Obtained demurrer and dismissal with prejudice in wrongful death case venued in Ventura County based on novel argument of negligent undertaking to circumvent California Dram Shop laws.
- Prevailed on motion for summary judgment for employer client in a wrongful death case venued in Los Angeles County based on finding that driver who caused the death was operating outside the course and scope of his employment.
- Obtained voluntary dismissal with prejudice and recovery of costs after initiation of jury trial in San Francisco Superior Court on behalf of client wrongfully accused of sexual assault and battery.
- Obtained a nonsuit and directed verdict on behalf of San Diego Metropolitan Transit System in a serious 44-plaintiff personal injury case following a one-week jury trial in San Diego County Superior Court.
- Obtained a jury verdict in a premises liability case with adverse liability in a bad venue for the defense, where the verdict was less than Plaintiff’s pre-trial statutory Offer to Compromise.
- Obtained multiple summary judgments in dog bite cases for one of the largest national pet retailers and one of the largest national multi-family dwelling REITs on the issue of notice to the premises owner.
- Obtained summary judgment on the issues of breach and notice for one of the largest national pet retailers in a case where plaintiff claimed she was injured when the sliding glass door closed on her as she entered the store.
- Prevailed on summary judgment motion for a utility company in a case involving catastrophic injuries sustained when plaintiff made contact with a 115,000 volt power line. The court found the utility complied with its statutory obligations and did not otherwise breach any duties owed to plaintiff.
- Obtained a jury verdict in a personal injury case for significantly less than the California Code of Civil Procedure section 998 offer to compromise, resulting in a nominal payment to Plaintiff after costs and expert fees were deducted from the award.
- Obtained dismissal with prejudice of premises liability action filed against Craft Brewery & Restaurant client immediately after deposing plaintiff (San Diego Superior Court).
- Prevailed on appeal of a successful summary judgment for an employer in a wrongful death action in San Diego Superior Court on the issue of whether an employee was acting in the course and scope of his employment at the time of the accident.
- Prevailed on summary judgment on the issue of “open and obvious” in a premises liability case where plaintiff fell off a three-foot ledge and fractured her leg.
- Obtained a dismissal at the pleading stage of all class and fraud allegations in a mold exposure case in Los Angeles Superior Court against the largest owner of residential apartment complexes in the nation.
- Successfully demurred and forced a nominal settlement in a personal injury matter. Subsequently recovered attorney’s fees via contribution claim against a third party in Orange County Superior Court.
- Succeeded on a motion for summary judgment in Sacramento Superior Court against sixteen plaintiffs alleging fraud in a mold exposure case, where case eventually settled for more than $6 million against the other co-defendants.
